After SPIN! "Question to John Hood and Chris Fitzsimon – Who owns the sand? That’s a question being raised by a retired couple who purchased oceanfront property at Emerald Isle. They claim their deed says they own the beach to the average high water line. A court of appeals ruling says the dry sand beaches in North Carolina are public property. The Supreme Court is going to consider the ruling. What’s your take on who owns the property?"

Living at the beach for 20 years John has it right... what throws something of a wrench into this though is the government defines the mean high water mark and when the government uses tax dollars to pay to nourish the beach they fix the mean high water mark to where it was before the nourishment... at least that is what was said before the Oak Island Sea Turtle project nourishment. Hopefully the NCSC will put a definitive answer down on this issue... of course with sea level rise predictions of 5ft plus through the rest of the century this may all be moot... for the current first row properties.
