Who was there first? The farmer or the homeowner? Even if it's one of those large industrial commercial hog farms, it still matters who was there first. Many years ago we had friends with relatives who bought a house near a mushroom farm. Needless to say they complained about the smell for the first few years. Eventually they got used to the smell and didn't even notice it. (i did when we visited!) But since the farm was there first, and the homeowners moved in KNOWING the farm was there, they had no recourse. Which is exactly the way it should be. And it was obvious the farm was there cuz the smell was overwhelming (in my opinion). So you knew before buying.
Is it the same with these farms & residential neighbors? Also, is the intent of these lawsuits to put the farms out of business? Sure seems that way cuz the farms can't afford too many decisions of this magnitude and remain in business. Is this good for the neighbors, the county, the state, and the nation to have these farms go out of business?
